Terms of Service

These terms govern your use of the NYOTAFUNDS LOANS Android application and this website. By creating an account you accept them. If you do not accept them, do not use the service.

1. Eligibility

You must be at least 18 years old and hold a valid Kenyan national ID and an M-Pesa registered number in your own name. You must provide accurate information; we may refuse or close an account where information given is false or misleading.

2. The product

Loan amounts: KES 500 – KES 50,000, subject to the limit assigned to your account.
Repayment period: minimum 3 months, maximum 24 months.
Interest: 12.5% per annum.
Processing fee: 2% one-off.

The exact terms offered to you are displayed in the app before you confirm, and it is those terms — not the illustrative figures on this website — that form our agreement.

3. Representative example

Borrowing KES 15,000 over 6 months: interest of KES 937.50 plus a processing fee of KES 300, giving a total repayment of KES 16,237.50. This is an illustration only.

4. Disbursement and repayment

Approved funds are sent to the M-Pesa number on your account. Repayments are made through M-Pesa on the schedule shown in the app. You may repay early; doing so reduces the interest charged.

5. Late or missed repayment

If a repayment is missed we will contact you. Persistent non-payment may result in the debt being referred for collection, may affect your credit standing with credit reference bureaux, and may affect your ability to borrow from us again. If you are struggling, contact us before the due date — we would much rather work out a plan with you.

6. Your account

You are responsible for keeping your phone and PIN secure. Do not share your account. Tell us immediately if you believe someone else has access to it.

7. Acceptable use

Do not use the service for anything unlawful, attempt to interfere with its operation, or submit another person's details as your own.

8. Availability

We aim to keep the service available, but we do not guarantee uninterrupted access. M-Pesa and mobile network outages are outside our control.

9. Liability

Nothing in these terms limits liability that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss arising from your use of the service.

10. Changes

We may update these terms. Material changes will be notified in the app. Continuing to use the service after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Kenya.
